CO Attorneys Made the Case for Fighting Police Abuses of Power

DENVER - One of the court cases nominated for "Case of the Year," by the Colorado Trial Lawyers Association, was never heard in a Colorado court, but it did have national implications in the fight against abuse of power by government officials, and did involve a Colorado law firm.

The case of DeLew versus Nevada Highway Patrol involved a cover-up in the death of 28-year-old Erin Rae DeLew, who was struck from behind on her bicycle by an intoxicated driver, who happened to be the wife of a Las Vegas police officer. Timothy Rastello, partner and trial lawyer from the Boulder law office of Holland and Hart, helped represent the DeLew family when no Nevada attorney was willing to take on the case. He says the resolution of the case sends a clear message.

"Police officers do not have to perform perfect investigations, but they cannot tilt the playing field and obstruct and destroy evidence in the favor of one of their own."

The case also validated the legal concept of "right to meaningful access to court," which Rastello says is violated when officials conspire to obstruct a citizen's civil action.

Rastello says the case has led to new policies in law enforcement agencies across the country for handling serious crime and traffic cases involving one of their own.

"They will call an independent, outside police agency, hopefully one that is not too connected either socially or professionally with the agency."

The case is also credited with increasing the awareness of the potential liability for law enforcement officers and agencies that engage in concealment and cover-ups of crimes.

The federal district court that heard the case said it "constitutes a warning to law-enforcement officers not to treat civilians unconstitutionally."

The Case Of The Year will be announced at the Colorado Trial Lawyers Association's spring dinner on May 13 in Denver.
