Local Governments Worried about SD Refinery Impacts

VERMILLION, S.D. - The Clay County Commission is asking the South Dakota Department of Environment and Natural Resources to reject a request from Hyperion Resources to extend the construction deadline for its proposed oil refinery in Union County. The commission is also asking the state to begin an entirely new process for approving the refinery's air quality permit.

Peter Carrels, regional representative of the Sierra Club in South Dakota, says even though the refinery is in an adjacent county, Clay County could end up with the brunt of the related expenses.

"I think the Clay County Commissioners have a very reasonable concern about how they will be affected in terms of infrastructure and the requirements that a refinery would necessitate. And they would not have any ability to gain tax monies through Hyperion to offset the costs related to developing infrastructure."

The refinery would be located four miles from the Clay County line, and eight miles from the county seat of Vermillion. Carrels says the Commission should also get a chance to make a case for a complete Environmental Impact Statement on the refinery.

"If you don't ask for an Environmental Impact Statement, you end up piece-mealing permits together and never getting a comprehensive look at what this project is going to do in terms of its impacts - and not just the environmental impacts. This is exactly what is leading Clay County to their concerns about really not knowing what's going to happen."

The state DENR has extended the current time for comments on the revised air quality permit to April 1.
