BEECH MOUNTAIN, N.C. - A wildlife sanctuary known as a haven for animals and an attraction for tourists and school groups is in a continuing fight against the town it calls home.

Genesis Wildlife Sanctuary filed a response this month to Beech Mountain's lawsuit against it. The suit claims the nonprofit is in violation of its 30-year lease of land on Buckeye Lake, which was signed with the town in 1999.

Genesis was forced to move its animals off the leased property in 2011, but the organization later concluded that some of the town's claims were in violation of the law and included false information. Genesis attorney Larry Price explains the impact the lawsuit has had on the sanctuary.

"There is no doubt that as far as the leased area is concerned, the town has basically destroyed Genesis. There's no doubt about that, and now the town is going to have to answer for it."

Genesis is suing the town for damages related to its forced move, and the case will go on to Superior Court.

Price points to evidence that the town has plans for the property that Genesis inhabited, which is the last piece of land that could be developed around the lake. In 2009 Beech Mountain passed an ordinance that stated that no animal could be caged or housed within 200 feet of Buckeye Lake, which placed Genesis in violation of its lease.

The sanctuary is relying on the generosity of supporters and friends of the nonprofit to fund its legal fight against the town. Price says they're not going down without a fight.

"The town, with an inexhaustible sum of money to spend on it, figured they'd just roll Genesis into the ground and that would be the end of it. Well, it's not the end of it."

When Genesis had to stop operating at its location on Buckeye Lake, many animals were moved to private properties but others had to be euthanized because there was nowhere for them to be housed.

The organization continues to help animals where it can. In December, volunteers rescued and rehabilitated a bobcat found injured in western North Carolina.
