Grupos defensores de los derechos de los migrantes están considerando emprender acciones legales para restablecer una ley de Texas que permite el pago de matrículas estatales a estudiantes universitarios indocumentados.

La medida se produce después de que el Departamento de Justicia demandara a Texas, y en cuestión de horas, los funcionarios estatales acataran la ley sin oponer resistencia. Según el fiscal general de EE. UU., la ley federal prohíbe a las escuelas brindar a estudiantes indocumentados beneficios que no ofrecen a ciudadanos estadounidenses.

La abogada de migración y socia del bufete Jackson Walker, Kelly Cobb, afirma que la ley estaba vigente desde 2001.

"Se les exige el mismo requisito de residencia que a los nacidos aquí," explica Cobb. "Y creo que es solo un argumento político. Fueron niños traídos aquí, ¿por qué deberían ser penalizados y tener que pagar una matrícula más alta?"

Texas fue el primer estado en promulgar una ley de este tipo para ayudar a jóvenes adultos sin estatus legal. Los legisladores conservadores han intentado derogar la ley durante años. Cobb dice que, si se presenta una apelación, un juez podría permitir que la ley siga en vigor durante el proceso de apelación.

El fiscal general de Texas, Ken Paxton, se atribuyó en parte el mérito de la derogación de la ley. La demanda se presentó pocos días después del final de la sesión legislativa, en la que un proyecto de ley para derogarla se estancó tras salir de un comité del Senado. Cobb afirma que, según el Consejo Americano de Migración, el estado perderá unos $460 millones de dólares al año en salarios si la prohibición permanece vigente.

"Va a tener un impacto financiero en las universidades," agrega Cobb. "Además, van a ir a la universidad, así que van a ser profesionales con títulos, que deberían ganar más. Van a ganar dinero y van a crear puestos de trabajo."

Esta medida forma parte de los cambios drásticos de la administración Trump contra la migración ilegal. Actualmente, 24 estados permiten que estudiantes indocumentados paguen la matrícula estatal.
