Renter Rights Expanding in Major Foreclosure State

Las Vegas, Nev. – Nevada is among the top states in the nation for foreclosure, and it's not just homeowners being put on the street. Thousands of renters also face eviction as owners of more condominium and apartment buildings go bust. About half the calls to Nevada Legal Services (NLS) are now from tenants who've just found out their buildings are going into foreclosure, according to NLS attorney David Olshan.

"It's typically tenants who are caught in the middle, and they want to know what their rights are. They want to contest the eviction, or see if a 'cash-for-keys' offer is a good one."

The "Helping Families Save Their Homes Act of 2009" (S896) took effect in May. Olshan says it gives renters 90 days to vacate the premises, a huge improvement over the three days they used to have under Nevada law. This gives them more time to find a new living space and, he explains, to negotiate with banks that may want them out early.

"There's a cash-for-keys concept out there - that if they leave early, they'll get more money. If they have the right to stay there 90 days, it's going to up the ante and provide them with more money to move out."

Attorney Rhea Gertken, also with NLS, says another new state law takes effect in October. It requires landlords to give renters advance notice that mortgage trouble is on the horizon.

"It gives renters notice that their landlord is in foreclosure proceedings, so now, the occupant of the property is going to be given a lot more notice under the law, that they might need to move out in a couple of months."

The law (AB140), which was passed in the last legislative session, also imposes civil penalties on landlords who rent a property that is about to go into foreclosure. Opponents of the measure had argued that a recession was a bad time to impose new rules on businesses.
