Same-Sex Marriage Now Legal in Nevada

CARSON CITY, Nev. - Same-sex marriage is now legal in Nevada following a ruling this week from the Ninth Circuit Court of Appeals.

Tod Story is executive director with the American Civil Liberties Union of Nevada, which filed a Friend of the Court brief in the litigation that led to the Ninth Circuit ruling. He says the three-judge panel determined the Nevada voter-approved ballot measure that bans same-sex marriage violates the constitutional rights of those involved.

"Couples in Nevada, regardless of their makeup, will now be able to marry and stand in front of friends and family and express their love for one another," Story says. "The laws of the State of Nevada are going to have to recognize that love."

He expects that marriage licenses will be granted to same-sex couples within about three weeks. Story says the Ninth Circuit ruling comes one day after the U.S. Supreme Court said it would not hear cases from Utah and several other states trying to preserve their same-sex marriage bans. Some legal analysts say the high court is signaling that it supports lower court rulings that have found same-sex marriage bans unconstitutional.

Nevada may stand out from many of the states where same-sex marriage is now legal, as the Silver State has long been considered by some to be the "marriage capital of the world." Story says Nevada could experience a wedding boom.

"Because they already have much of the apparatus in place, from wedding chapels and services available, it won't be too long before we catch up to the other states," he says. "We'll have couples of every gender coming to Nevada to get married."

An appeal to the Ninth Circuit ruling is highly unlikely, Story says, given that Gov. Brian Sandoval has said his administration will not defend the law banning same-sex marriage.
