Sacramento, CA - Una coalición, que incluye al Fondo de Defensa Ambiental, California y otros 8 estados, está demandando a la Agencia de Protección Ambiental de Estados Unidos (E.P.A.) para obligarla a implementar normas para regular la contaminación del aire en los vertederos. Comenta Susannah Weaver, socia de Donahue, Goldberg, Weaver y Littleton, firma de abogados que representa a la coalición.

California, ocho estados más y el Fondo de Defensa Ambiental están pidiendo a un juez federal que obligue al E.P.A. a actuar respecto a los estándares de contaminación para los vertederos. La descomposición de los residuos sólidos en los vertederos municipales emite metano, un potente gas de efecto invernadero vinculado al cambio climático. Susannah Weaver, abogada principal del caso, dice que la E.P.A. ha estado avanzando a paso lento durante tres años, con el argumento de que necesita tiempo para alinear los estándares con otras políticas futuras.

"Pero no explica por que debiera ampliar retroactivamente estos plazos, que debian haberse cumplido por completo hace muchos anos si no hubiera sido por la accion ilegal de la EPA para retrasarlos."

En 2016 la administración de Obama estableció estándares para que cada estado elabore un plan que mitigue la contaminación del aire de los vertederos, o que esté sujeto a un plan federal. El programa de California exige que los vertederos municipales instalen tecnología para captar el metano.

Weaver dice que los vertederos también emiten benceno, -un hidrocarburo tóxico que causa cáncer- y compuestos orgánicos volátiles que generan "smog".

"La conclusion aqui es que estos rellenos sanitarios emiten cientos de miles de toneladas de contaminacion peligrosa que deberian controlarse en este momento, pero aun no se implementa."

Mientras tanto, el jueves, la administración Trump revirtió otra regla federal de la era de Obama que limita las emisiones de metano originadas por instalaciones de petróleo y gas.
