Albany, NY - Demonstrators who say a Long Island home health care company is union-busting will rally outside the firm Friday afternoon to call for passage of federal legislation that will make it easier for employees to form a union if they choose to. A local of United Healthcare Workers East has been trying for two years – without success - to unionize employees of Able Health Care in Merrick. The rally will use the situation as an example of why they want Congress to pass the Employee Free Choice Act.

Charlene Obernauer, organizer for Long Island Jobs With Justice, says the the workers are facing off against the firm’s president, Michael Shapiro

"He’s a friendly guy; I’m sure that he’s a good person. I’m sure that he’s trying to do the right thing. But the fact of the matter is that he needs to know the right thing is letting these workers choose freely to form a union. These workers have said that they want a union, have been very interested in joining a union and he is pressuring them not to and this, we feel, is the perfect example of why the Employee Free Choice Act is so important."

Shapiro denies he is union-busting.

"Oh, well we totally disagree with that. I don’t even know where that came from - union busting. The decision to join a union or not is up to the employees. We have nothing to do with it. We just try to tell them the facts; that they have to pay dues, they might have to go on strike, and things like that."

He has held meetings with the union, adds Shapiro.

"In the meetings, we present what we pay and our benefits. And they continually say that 'you pay well and you have good benefits.' But they’re looking to increase their membership and their dues."

The rally is scheduled for 4:00 p.m. near the Able Health Care offices in Merrick.
