Dark Money Battle Back in Congress

BOSTON – A group of lawmakers in the U.S. House has introduced a bill to amend the Constitution, in an effort to fight the influence of so-called dark money in politics. The "We the People" Amendment would overturn the 2010 Citizens United decision by the Supreme Court, which said corporations have the same constitutional rights as individuals, and identified political donations as a protected form of free speech.

In Concord, the president of the group American Promise, Jeff Clements, believes the decision needs to be overturned, and he notes the Bay State has been out in front on this issue.

"We've seen for the past several years, building cross-partisan support for this kind of constitutional amendment; Massachusetts actually is one of the earliest states that have formally called on congress to pass this amendment," he said.

People who agreed with the Supreme Court decision in Citizens United take the view that corporations should have a First Amendment right to free speech, and the right to donate as much as they want, privately, to any candidate or cause.

The amendment has been introduced multiple times in the past few years, but the Republican majority in Congress has blocked a vote.

Keyan Bliss, the communications director for the advocacy group, Move to Amend, says 18 states and hundreds of cities and towns have passed nonbinding resolutions supporting the idea of overturning Citizens United.

"We're hoping that we are able to pressure Congress to take action, with the threat that states will take action if they do not," he said.

To pass, the amendment would need a two-thirds vote in both houses of Congress and be passed by three-quarters of state legislatures. Or, three-quarters of the states could approve it and force a constitutional convention.
