Cambios en la Ley de Asistencia Médica para Morir de CA impulsan su uso en un 47%

Según un nuevo informe del Departamento de Salud Pública de California, una ley que acorta el periodo de espera para la ayuda médica para morir incrementó el uso de la ley en un 47%, tal y como lo esperaban los legisladores.

En 2021, los legisladores modificaron el End of Life Option Act o Ley de Opción de Fin de Vida para reducir de 15 días a 48 horas el periodo de espera obligatorio entre las dos solicitudes verbales requeridas para los medicamentos de ayuda médica para morir.

Samantha Trad, del grupo Compassion & Choices, dice que el cambio brindó alivio a cientos de pacientes adicionales.

"En 2021 se prescribieron 863 recetas," informa Trad. "El año pasado, con los nuevos cambios en vigor, se dieron 1,270 recetas."

Los datos también mostraron que casi 4 de cada 5 pacientes con enfermedades terminales esperaron menos de 15 días entre las dos peticiones verbales. Un estudio de 2018 de Kaiser mostró que el 21% de los pacientes que solicitaron recibir la Ley de Opción de Fin de Vida murieron durante el periodo de espera de 15 días.

La Dra. Chandana Banerjee, de City of Hope de Duarte, señala que algunos enfermos terminales se deterioran con rapidez, lo que puede hacer insostenible el periodo de espera de 15 días.

"En esos 15 días, pueden perder el conocimiento, pueden perder la capacidad de ingerir" dice Banerjee. "Y en ese momento, dejan de calificar para participar en la Ley de Opción de Fin de Vida porque tienen que tener la capacidad de ingerir por si mismos."

Algunos hospitales no ofrecen todas las opciones de atención al final de la vida, citando objeciones religiosas.

Los activistas piden a los sistemas de atención médica, y los que se conocen en Estados Unidos como hospicios, que cumplan la ley y publiquen sus políticas de ayuda médica para morir en sus sitios web.
